1. INTRODUCTION AND CONTRACTUAL RELATIONSHIP

Welcome to VELZEEN (“we”, “us”, or “our”).

These Terms and Conditions (“Terms”) constitute a legally binding electronic contract between you (“User”, “Customer”, or “you”) and VELZEEN, a sole proprietorship firm having its registered office at: B-6-966/50X, Street Number 10, Harbanspura, Gaushala Road, Ludhiana, Punjab – 141008

By accessing, browsing, registering, or transacting on www.velzeen.com (the “Platform”), you agree to be bound by these Terms, along with our Privacy Policy, Shipping Policy, and Return & Refund Policy.

This document constitutes an electronic record under the Information Technology Act, 2000, and does not require physical or digital signatures.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE PLATFORM.

2. ELIGIBILITY

Use of the Platform is available only to persons capable of entering into legally binding contracts under the Indian Contract Act, 1872.

You must be at least 18 years of age to transact independently
Minors may use the Platform only under parental or legal guardian supervision
VELZEEN reserves the right to restrict or terminate access to users who violate these Terms

3. ACCOUNT REGISTRATION AND SECURITY

To access certain features, you may be required to create an account.

3.1 Responsibility

You are responsible for:

Maintaining confidentiality of login credentials
All activities conducted under your account

3.2 Accuracy of Information

You agree to provide accurate, current, and complete information.

VELZEEN shall not be liable for:

delivery failures
delays
losses
arising due to incorrect information provided by you.

4. CONTRACT FORMATION: INVITATION TO OFFER

4.1 Nature of Listings

All products listed on the Platform constitute an “Invitation to Offer”.

Your order constitutes an “Offer” to purchase.

4.2 Acceptance of Order

A contract is formed only when:

the order is dispatched from our warehouse
Order confirmation emails/SMS are acknowledgements, not acceptance.

4.3 Pricing Errors

In case of pricing or technical errors:

VELZEEN reserves the right to cancel orders
Full refund will be issued if payment was processed

4.4 Right to Refuse or Cancel Orders

We may cancel orders due to:

stock unavailability
pricing errors
suspected fraud
verification failure

5. PRODUCT INFORMATION AND DISCLAIMERS

5.1 Visual Representation

Product colors and textures may vary due to screen settings. Absolute accuracy cannot be guaranteed.

5.2 Product Variations

Minor variations in design, texture, or print may occur and shall not be considered defects.

5.3 Size and Fit

Customers are advised to refer to size charts. Fit may vary based on design and fabric.

6. PRICING AND PAYMENTS

6.1 Pricing

All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.

6.2 Payment Methods

We accept:

Credit/Debit Cards
UPI
Net Banking
Wallets
via secure payment gateways.

6.3 Cash on Delivery (COD)

Available for select locations
Subject to verification
May be restricted for high-return accounts

Restriction: COD is not available when free shipping coupons or promotional codes are applied.

7. SHIPPING AND DELIVERY

Shipping terms are governed by the Shipping Policy.

Key terms include:

Shipping fees applicable as displayed at checkout
Delivery timelines are indicative
Customer bears re-shipping costs for incorrect addresses

VELZEEN is not liable for delays caused by logistics partners or force majeure events.

8. RETURNS, REFUNDS AND CANCELLATIONS

Returns and refunds are governed by the Return & Refund Policy, which forms part of these Terms.

Key conditions include:

7-day return window
Products must be unused and in original condition
Refund method depends on payment mode
Reverse shipping may be charged for customer-initiated returns

9. VELZEEN STORE WALLET

The Velzeen Wallet operates as a closed system store-credit mechanism.

9.1 Usage

Can only be used on the Platform
Cannot be withdrawn or transferred

9.2 Refund Credits

Refund-based wallet credits:

have lifetime validity
remain active while the account exists

9.3 Promotional Credits

Promotional credits:

may have expiry dates
are subject to campaign-specific terms

9.4 Restrictions

Wallet cannot be used with COD
Wallet is auto-applied at checkout

10. USER CONDUCT AND PROHIBITED USE

You agree not to:

violate any applicable law
infringe intellectual property rights
misuse return policies (“wardrobing”)
submit false or misleading information
engage in fraudulent activity

VELZEEN reserves the right to suspend or terminate accounts in such cases.

11. PAYMENT DISPUTES AND CHARGEBACKS

11.1 Dispute Resolution

Customers must contact VELZEEN before initiating any payment dispute or chargeback.

11.2 Misuse of Chargebacks

Chargebacks raised after:

successful delivery
failure to follow return policy
shall be treated as policy abuse.

11.3 Evidence

VELZEEN maintains:

payment records
delivery confirmations
tracking logs

These serve as valid evidence in disputes.

11.4 Enforcement Rights

VELZEEN may:

suspend accounts
disable COD
recover losses
initiate legal action

12. INTELLECTUAL PROPERTY RIGHTS

All Platform content is owned by VELZEEN and protected under applicable intellectual property laws.

Unauthorized use, copying, or reproduction is strictly prohibited.

13. INDEMNITY AND LIMITATION OF LIABILITY

13.1 Indemnity

You agree to indemnify VELZEEN against claims arising from:

misuse of the Platform
violation of these Terms

13.2 Limitation of Liability

VELZEEN’s liability is limited to the value of the purchased product.

We shall not be liable for indirect or consequential damages.

14. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India.

All disputes shall be subject to the jurisdiction of courts in Ludhiana, Punjab, unless otherwise required by applicable law.
